  • Unable to convert PIO to OCI - what to do

    I have been residing in India with my PIO holding minor son (US citizen) for the past several years. PIO is valid for several more years. I had registered him with the FRRO and got a residential permit earlier.

    I am divorced and my ex is not in touch with me or my son in any way since past several years. My son being a US passport holder, his passport has expired, however my husband never replied back to requests for signing the consent for renewal of US passport. Hence the residential permit also expired recently.

    I asked the US consulate regarding renewal of his passport and they said that he cannot travel until he is 16 years of age and can apply for the renewal of passport himself when he is 16.

    The last time I visited the FRRO office a year ago with this dilemma I was told that since I was helpless in this situation, to continue with his stay without traveling anywhere. This was just a oral response by one of the officers with nothing in writing.

    Kindly advice me what to do in such a situation to obtain his OCI card? The document checklist states that a valid passport and both parents signature is required for conversion of PIO to OCI.

    Can the minor child be deported out of India by the FRRO? Can I bring a stay order in such a situation as I am an Indian citizen and there is no one to take care of his safety in the US

    I think all what you are missing the court order stating you are sole custody of the minor, father has no visitition right, and all decisions are granted to you only
