  • New Born Canadian citizen of Indian Parents

    Hi all ,
    I am currently on work permit at Canada with spouse and I expecting baby here in month of Jan 2018. As a Indian Citizen I am bit confused whether to take Canadian citizenship for my baby or should i go ahead with Indian citizenship. What are the pros and cons of this.

    In case of NO long term plans in Canada will it be so complicated if i take Canadian Citizenship for my kid and grow him in India after few years till he gets eligible (18 +)
    Will there be extra burden in terms of money , documentation for foreign kid in India for education and other aspects.

    Congratulations!

    I'd say definitely get Canadian Citizenship. You never know what the future holds. You will be giving him a huge gift.

    As a Canadian he will be able to hold Citizenship from another country.

    If he doesn't get CA citizenship, you need to consider what his status would be for healthcare and school in your province.

      There is no such thing as "take Canadian Citizenship" -- the child born in Canada will be automatically and involuntarily a Canadian citizen, according to Canadian law. Neither you nor the child has any choice in this matter, and a minor cannot renounce Canadian citizenship even if they wanted to.

      However, that doesn't mean the child is not also an Indian citizen. According to India's Citizenship Act, a child born abroad to at least one Indian citizen parent is an Indian citizen by descent if the child is registered within one year of birth at an Indian consulate and the parent declares that the child does not hold a foreign passport. So as long as your child doesn't get a Canadian passport, they will be an Indian citizen like any other Indian citizen. (However, as a Canadian citizen, it will be difficult to return to Canada without a Canadian passport once your child leaves, and getting a Canadian passport later can cause loss of Indian citizenship.)

        Get the kids Indian passport. If they end up needing a Canadian passport, they can get one. If they get a Canadian passport, you foreclose their opportunity to get an Indian passport. It's better to have options available

          Hi All,

          I also have a question where I need suggestions and guidance. Currently me and my husband are Indian Citizens and living in Canada. Soon, we are going to apply for Canadian Citizenship as we have plans to move to US (for few years) for better growth opportunities. Fortunately if we have a baby there in US, automatically he will get US citizenship and Canadian citizenship (this I am aware of). We have future plans to move back to India and we can apply OCI status. Will our kid be able to apply for OCI status and/or in future, will be able to apply for Indian citizenship? If yes, then what will be the processing time? Thanks in advance.
