  • Visa/PIO/OIC or Indian Passport for US Birth child

    Hi,
I am in a little delimma/confused state ,after reading so much.

I am going to have a child and would not have enough time to wait for getting US passport and then OIC stamp. (I heard OIC card takes min. 2 months and it can take upto 6 months too). Plus it has its own dis-advantages as its not an indian citizenship and hence higher education cost in india.

I am not planning to have frequent trips to US in coming time. And in most cases, my baby would get education in india only.Hence getting Indian Passport and thus indian citizenship would be beneficial.
Now since my child would have "US certified Birth Certificate", would she be eligible to get US Passport made in india through US Consulates, if she wants to in future? Is there a age restriction on it? Is she require anything else other than "birth certificate" to get US passport in future?
Kindly help me in finding answers to these questions.

From the US point of view, there's no problem with the above scenario. The birth certificate showing birth in the US is sufficient proof of her US citizenship for the passport application. You also need proof of her identity. Her Indian passport is probably sufficeint for that.

There are not currently any age limits or residency requirements for retention of US citizenship.

If you read it carefully, you'll see there are not many ways a person can lose US citizenship, unless the person actively does something with the deliberate intention of losing it.

From the Indian point of view, getting a US passport makes the child lose Indian citizenship. So after you get her a US passport, you have to get her Indian passport cancelled. You can then apply for a PIO card to get her back in status in India. Your local Indian consulate should be able to answer more detailed questions about that.

    Hope this helps,
