  • Family group applicable to me?

    guys

    I'm of indian background and already have an OCI and so does our 1st child. Now I want to apply for OCI for my wife who is not of indian background and for our 2nd child. Wife has a 10 year visa so I didn't apply for her initially but that visa only has 2 years left

    Should I apply as a family group or just put in 2 individual applications for both of them

    I'm not for sure about this, so it's highly recommended you speak with an immigration attorney, but I'm pretty sure if someone is not of indian origin, they cannot have either the PIO or OCI card. you're 2nd child can because through you she has indian origin, but I'm pretty sure you can't apply for your wife.

      The rules are pretty clear - spouse of foreign origin but married for 2 years to someone of indian background is eligible. I don't want to muddy the question; here is the original question again:

      I already have OCI and so does our 1st child. Now I want to apply for OCI for my wife and for our 2nd child. Should I apply as a family group or put in 2 individual applications for both of them

        IMO, apply individually. It will be easy to deal with. If you are not travelling to India soon, apply for one, get OCI and then apply for the other.

          got it - also any reports of how long it's taking from new york? chicago and atlanta have some reports of just a month in the other thread but the ckgs website seems to indicate some system changes are delaying things
