OCI Card question with expired visa & I94

Hi All, Need some advise about a situation. My primary & wife's dependent visa & I94 will be expiring by early Jan and extension will be applied prior to it. The second part is that we expecting a baby by Feb. I heard that OCI card or any type of India visa can not be applied if parents visa is not valid for 3 months. Did anyone had similar situation and what are the options in case need to travel to India? Do they accept extension acknowledgement as extension results might take more time. Thanks for all the help.

If your wife is an Indian citizen no question of OCI card arises. If your wife is neither an Indian nor an US citizen, than may be it is true that her current I94 has to be extended before she can qualify for an Indian visa. OCI is only for non-Indian citizens who are citizens of a country other than India and are legally residing in the country of citizenship or in the country of their residence. If the OCI card if for your baby, then you can apply as soon as the baby has a US passport. But it is far easier to get a 6 months or longer regular visa for this time and then get the OCI card for your child later.
