Separated parent trying to renew kid's OCI from India

I had a baby in US and have moved back to India because of the mental abuse. I am currently going through a divorce in India. I have a 3 year old with me whose both passport and OCI will be up for renewal soon. The litigation process is taking too long. I do not have sole custody of my child yet. How do I renew my child's US passport and OCI without my spouse's signature ?
