  • US born traveling out of USA on Indian passport

    I am on L-1 visa which will become GC in a couple of months. My daughter was born in the US and I am planning to get an Indian passport for her.

    The baby's Indian passport will not have any I-94 or American visa etc because from American point of view the baby is American so they can only give passport, not visa.

    The question is whether there is any problem in boarding the outbound plane in US and transiting in Europe to India, with an Indian passport with no visas? Is there any airline or immigration which might not accept this?

    since you will be travelling to India not USA you will be fine, you dont need a US visa to travel to any country other than USA.

      I am curious to know how do you get an Indian passport for a baby born in the United States?

        you apply to the indian consulate showing that citizenship is obtained through parents and certifying that you have not applied for US passport.

          Thanks for the clarification. So, the parents can can choose to opt for either Indian citizenship or US citizenship for their kid.

            Yes they can, but the hitch lies in the fact that if they want to return, the US consulate will not issue a visa but a passport for the child, and that is contrary to Indian laws which require that they denounce Indian passport.

            So it is pretty much a one way decision there, though the child can apply for US passport anytime based on birth location.

              Ah!

              Ah! That's why all the parents I know choose to opt for US Citizenship for their kids and get US passports.

              Then they get the PIO cards for the kids to travel to India.

              Perfect.

              I wonder, why this person herein wants to get Indian PP for the kid.

                most people take US citizenship because its probably a dream come true for them without realising that they are giving up indian citizenship. why give it up when you can retain both the options while staying in india

                  because, often they are travelling between the two countries, not amking a one way trip after the birth of the child

                    Wrong information above.

                    European countries except UK, let Indians transit because of valid US visas. The question is whether airlines let you board a flight to India with transit in Europe if you do not have either a US passport or a US visa. The question is whether the US birth certificate is considered by them as a proof of your US residence to allow you to pass without needing a separate visa.

                      but you are not travelling to USA but to India so why would you need a valid US visa. it varies from country to country.

                        If you see any problem, then why can't you apply for Transit Visa for Baby. Other thing, how you will come back to USA without US Passport. As per your quote, you will be getting GC soon.

                          i am getting GC because my company is doing it, actually i asked not to bother but they still went ahead and so my plan is not be come back

                          as for transit visa, each country has its own rules and depends on the country of transit and the airline therefore i am looking for people who have gone the same route before so i can get some guidence
