  • Legal Status of baby born in US but having Indian Passport

    Hi,
We are expecting our child in Dec'08. We are currently on H1/H4. We are not decided on whether we would like to settle here in the US or go back. Having heard a lot of conflicting opinions abt having a child here vis a vis in India, we are totally confused. Here are some questions we have. Would be grateful if someone could answer these.

    1. Can we apply for an Indian passport for a US born baby? If yes, what is his/her legal status in US? As dual citizenship is allowed here, will he/she be given US citizenship as well?

    2. Since the child will have a US birth certificate, will he/she be considered NRI for education in India?

    3. Does anyone have any info on NRI fees for bangalore schools?

A baby born in US will always be a US citizen by birth. India will issue a passport for the baby but it has to be surrendered once the baby has to travel back to US as a US passport would have to be utilized for that purpose.

As far as education and being NRI for that purpose, I have no clue.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
