    Hi,

    Iam a Indian citizen living in US married to Chinese citizen. Both of us are in US on H1-B work visa. Recently we applied for PIO cards for our US born children and Indian consulate Houston rejected application citing Mother as Chinese citizen. Can we apply for OCI card for our Children? I couldn't find anything on OCI that restricts chinese connection via mother. But I dont want to go through all the effort of application and find that there is a restriction on this as well. Please advice.

    Nope, OCI doesn't apply ...

    ... until you become an US Citizen.

      Was your wife ever a citizen of India, then your kids will qualify.
      Are you citizen of India at the moment then your kids will not qualify till you give up that citizenship.

      OCI is available to people of Indian origin but is limited to citizens of certain countries only and China is not one of those countries.

      The kids of Indian citizens can only get PIO cards not OCI till at least one parent gives up Indian citizenship
