Extesion of short validity passport question?? Pls help

My old passport is going to expiry in nov 2009. I applied for renewal of my passport at Indian consulate, NY. They had given short validity passport for 1 year which is expiring in sep '09. I don't have valid US visa in old passport but i do have new h1b approval papers.

Now my question is can i apply for extension of short validity passport after 45days with these new h1b approval papers(because i am not planning to go india next year also so i cannot go for visa stamping). Any one please clarify?

I want to renew my passport too and my visa also expired on my passport. Did you have the h1b approval papers when you applied for renewal? Let me know what happened in your case.
