I need help regarding my OCI application. One of the requirements for OCI application is "Last Indian Passport held in original" and two copies of the same. We also need to send the "Current US passpor" of the same.
Here are the facts:
- My wife got her US citizenship 12 years or so ago before she was married to me. Her last Indian passport has her maiden name and is now expired.
- When we got married 5 years ago she went to an American court and officially changed her name to include my last name.
- She now has an American passport with her married name.
- Hence the name on her current US passport is different than the name on last Indian passport.
Now the problem is that the application says the following "IF YOUR NAME IN YOUR US PASSPORT IS DIFFERENT FROM THE ONE IN THE INDIAN PASSPORT, YOU ARE REQUIRED TO ADVERTISE CHANGE OF NAME IN A NEWSPAPER IN YOUR LOCALITY IN USA, AND IN INDIA. COMPLETE AND NOTARIZE THE CHANGE OF NAME AFFIDAVIT."
I really do not feel I need to do all of this since I have a document from a court which clearly documents her change of name.
What should I do? Here are my options.
1. Send copies of her Indian and US passport along with the document from the US court authorizing her name change.
2. Advertize in India, US etc about change of name and fill affidavit.
3. Give up on OCI application for her.
I first sent the application without the passport and some other documents, but it was returned to me. I lost $25 in postage due to this. I am afraid that if I go with option 1 above they will again return documents to me and ask for more.
Any help is appreciated. Also does anyone know of a contact number or email at Consulate in San Francisco that I can send my questions to?
