New OCI Card for Minor while Parents H1B and H4 Extension is in Progress.

Hi,

I am applying new OCI card for my daughter born in Jan 20. My current visa is expired and I 94 expired on 9-Apr-20. Currently extension is in progress for both H1B and H4.

1) I read some blogs that said I 797 Receipt is not accepted as valid document for parents valid legal status and their applications were put on hold. Did anyone face this issue recently?
2) If my H1B gets denied, what options I will have to travel back to india with my family?

I want to be cautious before applying OCI because my passport will be stuck and in case I get a denial I will have another headache to get the passport back from them and get a emergency visa.

Any advise is appreciated.

I had a word with Indian Consulate and they confirmed that approved H1b and H4 is needed to apply for OCI.

can you provide some update on what you have done ? Did you get any positive update on the H1 extension or are you taking another route for your infant ?

And, how long did it take for you to get the passport for your infant ?
