  • Tourist visa to OCI

    Greetings everyone.

My infant (3 mo) daughter entered India on a Tourist visa (5 year validity, 180 day maximum stay). I received her OCI card (in US) shortly after she went to India (Pune) (with her mom). Now we're coming up on the 180 day mark and I was looking at options to extend her stay beyond 180 days (Ideally till June 2021). When I called Mumbai FRRO office, they said that since she's received the OCI, she can stay as long as desired and nothing further needs to be done. But I received an email from the Chennai FRRO office (whom I'd emailed earlier) saying that if you enter on Visa then you must exit on Visa.

My situation is a bit like this Poster. https://www.immihelp.com/experiences...E-Visa-172848/

    Questions

    1. There is no written record of my conversation with the Mumbai FRRO office, and I have nothing to show if we're stopped at exit time.

    2. Both myself and my wife are naturalized US citizens, with valid OCIs. Can my daughter be considered a person of Indian origin since her grandparents are Indian citizens?

    3. What options do we have to extend her stay until June 2021 once her 180 days permitted by her tourist visa are up?

    Thanks in advance

    CA Father.

There are many posts where FRRO has made adjustments in their systems (especially for infants) who entered on visitor visa and then converted to OCI.
To do this, she must be in possession of the OCI card.
Visit the FRRO office, explain the situation and have the adjustment made.

Thank you R78. I was only able to find one example post linked in my original post. Can you please point me to a few more examples to help my research? Thanks again.

I suggest visiting the FRRO to extend the stay for the visa and also enquire about using OCI. When the immigration/emigration officer scans the passport, he/she is going to see the visa used in the entry and the 180 days expired. It depends on the officer to let your child travel further. If you can't risk that, visit the FRRO and get the visa to stay extended and enquire about updating the immigration record with OCI and get a paper copy as proof.
