Eligibility for OCI

My husband and son are US citizens by birth. I’m naturalized US citizen and previously was citizen of India by birth. I renounced my Indian citizenship few years ago.

can my spouse and son apply for OCI card ?

I don’t have OCI card yet but wondering if they need to wait till i get my OCI and then they can apply or they can just apply based on me being a person of Indian origin.

Very confusing and hard to get any information from the embassy.

Yes, all of you can get OCI.

As per rules, you do not need to have an OCI for your husband and son to apply. But VFS is handling things poorly, their reps are not properly trained and are not fully aware of the rules. So, IMO, it is better if you apply and get your OCI first and then have your husband and son apply.

Download the document checklist from the VFS site and go through it. It has the requirements listed for those applying on basis of spouse and on basis of parent/grand-parent.

Hello,

I am Indian born Naturalized US Citizen and my wife is US born citizen.

I want to apply for OCI for myself only, as my wife doesn't need OCI.

Question 1: Do I need to submit marriage certificate If I am applying only for myself?

VFS global website has unclear Information on marriage certificate.

Any help would be appreciated.

I know what you’re saying about VFS. Same goes for Houston embassy as well. Never get an answer to what you’re asking them that is if they ever respond to mails and calls.
i guess all govt offices everywhere run like that.
