Having baby in USA and keeping Indian Citizenzhip

Dear Immihelp users,

Me(H1B) and my wife (H4) are Indian citizens living in USA.

If we have child in USA ,

1.Can we register the baby as Indian citizen and apply for Indian passport?

2. Is the US Birth certificate enough for leaving US and for re-entering will US give Visa for the US born child in India?(Chennai consulate)

3. Since the child as US birth certificate can the baby at the age of 18 decide which citizenship to keep and apply for US Citizenship after surrendering the Indian passport if required?

1. Yes, you can. You have to register the birth and apply for the passport within 6 months of child's birth.

2. US will not issue Visa to a US born child. They will ask you to apply for a US passport.

3. US considers the US born child as a US citizen, so your child should be able to apply for a US passport. US law does not require you to surrender your Indian passport, but Indian laws require you to surrender the Indian passport if such a thing ever happens.
