  • Indian PP for US born

    Dear all,
Hope you are doing well. I would like to know the cons of obtaining US passport for US born baby.
My son is US born and we intend to travel back to India atleast for initial few years and we may come back to US. Considering this fact, I have below questions:

1 : If we apply for his Indian passport then returning back to US would require him a US VISA? as US doesn't give VISA to US citizens ( my son is by birth US citizen)
2 : if we apply for his Indian PP, does he loses his US citizenship status as India doesn't recognize duel citizenship.
3 : upon obtaining Indian Passport, if he doesn't loses his US citizenship , then having India PP , isn't considered him as duel already?

    Thanks Amit

Get SSN & US passport for your son immediately. People are waiting nearly 20 years for a green card, and your son has the chance to get a US passport right away. Do not second guess it.

Once US Passport is in hand, get OCI for him so that he can travel to India without any restrictions. OCI holder has mostly the same rights as Indian Citizen except for a few exceptions - cannot vote in India, cannot hold public office and cannot purchase agricultural land (but can inherit it).

If, for some reason, your son wants or needs Indian PP, he can decide on that when he turns major (18 years old). And yes, Indian doesn't recognize dual citizenship, so he will have to give up his US citizenship and show proof before getting Indian PP.

      1. He cannot get a US visa, since he is a US citizen. He can only get a US passport, but getting a US passport may have implications for his Indian citizenship. The only options for him to enter the US without a US passport would be to enter by land from Canada or Mexico.
      2. No, it's not possible to lose US citizenship involuntarily. He cannot even give it up voluntarily at a young age even if he wanted to.
      3. Yes, upon registering him as an Indian citizen, he is a dual citizen.

This is my personal opinion and is not to be construed as legal advice.
