  • PIO Card for US citizens of Pakistan Origin

    Hi,
    I was a former Indian Citizen and now a US citizen. I got married to a US citizen of Pakistan origin few years ago. My question is can I apply PIO card for my married spouse who's US citizen but born in Pakistan. Please advise.

    No PIO or OCI

    She does not qualify for PIO or OCI. She can only get a visa that also after long term inquiry lasting for more than 6 months. Hence apply for the visa well in advance.

    This is what is quoted in the Indian Law:

    "Please note that persons who were citizen of certian specified countries or whose spouse or either of whose parents, grandparents, great-grandparents were citizens at any time of these specified countries may cause an applicant to be ineligible for a PIO cards even though they fulfilled the above criteria."

    The above law is for spouse of Indian citizen but parents, etc. belong to countries like Pakistan, Bangladesh, China, etc.

      Thanks for your reply. Do you think is there anything going to change in near future? Is any effort being made to persuade maker of this inhuman law to change the rigid stand?

          What is inhumane about this ? she is a Pakistani origin and thats a fact.

            why do you just not allow pakistani, sri lankan, bangladeshi, chinese origin? You should have one rule for all citizens. If you married to Canada origin, etc then you give PIO or OCI .Is it not inhumane you create hurdles to visit loved ones and keep away from parents and other relatives? How do u feel if US doesn't give you green card or the citizenship even after you pay all the taxes and fulfilling other obligations?

              Most of these rules are based on treaties and on a reciprocation basis. If the other countries in question do not allow it, then India would not allow it either. That is not in the hands of you or I or this forum.
