  • OCI card for non-India spouse: Question about Apostille marriage certificate

    Hello all.
I have an OCI card with a US passport. My wife is American (US-born), with a US passport, and is not of Indian Origin. We live in Dallas TX.

We were married in 2020 in TX and have a Marriage License from Local County, State of Texas. It has the Seal of Approval, from the State of Texas.

We are in the process of applying for my wife's OCI card. We are confused regarding one of the documents, APOSTILLED MARRIAGE CERTIFICATE, as asked per the OCI card Checklist

    Questions

    1. Is the marriage License from the local Country with Seal of Texas, sufficient and compliant with APOSTILLED MARRIAGE CERTIFICATE to be submitted for my wife's OCI application? If not, what extra details are needed?

    2. What is an Apostilled Marriage certificate, and how do I get it, for the purposes of my wife's OCI application? Who needs to issue this Apostilled Marriage certificate? Can you please share details on the process of getting such a certificate, based on our context as explained above?

    3. There is a question on the online OCI application form: "If Marriage is solemnised abroad/Outside India, whether the marriage certificate is Apostled/certified by the Indian Mission/Post Concerned: Yes | No ": We are confused by this question. What is the purpose of this question? In our case, we do not have our Marriage Certificate certified by the Indian Mission. So, if we answer NO, what are the consequences for my wife's OCI application? Is there anything negative to be aware of?

    Thank you

They double-check and triple-check all documents you send them. Getting an apostilled marriage certificate is one of the new things, I guess. Google how to do it in your state. You have to send it to a county or state office, and they will put/stick a seal on the original certificate and return it to you. There has always been a concept of self-attestation in India. I'm sorry, but please get over it and get it done the way they want it.
