    Hi,

    I have come to US on an L1 visa for a 2yrs assignment. My company needed me to travel to US immediately. My wife was pregnant then and I wanted to be around during her pregnancy, so she accompanied me. Unfortunately I did not know that having the child in USA - would make my son eligible only in NRI quotas for schools back in India when I return. This is a big concern for me where I have to shell out a lot of extra money for my child's education.

    Is there any way around this? I would be returning to India in 6 months.
    I am applying for my son's PIO right now.

    Unfortunately, no.
    If you had not applied for a US passport for your son, then there is a loophole in Indian law where you can register your child's birth at your nearest consulate and apply for an Indian passport (flawed as that sounds, Indian law lets you do it); but if you already have a US passport for your child, there doesn't seem to be any way around it now.
