    Hi,

    your advise is really appreciated. I facing a big problem. Here is my case
    I am an Indian citizen currently working in US on H1B. My husband is South African citizen and my kids are born here so US citizens. My husband was born in India and was having indian passport and used to renew the passport as it expires in south africa. He became south african citizen and got his south african passport and got his h1 stamped on that and came to US on 2007 dec. In 2007 sometime he used his SA passport to go to India. later in 2008 (when he was in US)he renewed his indian passport in South africa(while he was holding SA passport, not knowing that it is not a right thing to do),and got it renewed in 2008. In the same year he went to india again using his SA passport and came back. But still he didnt surrender his indian passport, though he had a plan to do that. Now recently we were in a position to send our kid to India and applied for PIO card for her, then the indian embassy asked us to submit both his Indian and SA passports. Later they denied PIO for my daughter and holded my husbands passports. When we went to collect the passport the embassy said what he did is illegal and they cancelled my husband's indian passport and banned my husband and my kids from even getting a tourist visa to india. Is there any possibility of getting a tourist visa to india for my husband and kids. Both our families are back in india. so we are in a big trouble now. Please someone help us here

    There is no hope now. What Indian govt did was right. India doesn't allow dual nationality and it is usually stamped in the passport that if the holder acquires another nationality, then the passport must be surrendered. He should've known better.

    As far as going back to India, your husband and kids can take a visa to Nepal and then travel via land from Nepal to India.
