Indian British Mother Pakistani Father - OCI for minor

  • Indian British Mother Pakistani Father - OCI for minor

    Im Indian woman by birth and British by naturalisation remarried recently to Pakistani National. I want to settle in India as my other kids and own house all in India. I am worried about the nationality of my unborn child coming soon as I want the child to be Indian National either by birth in India or by having him/her OCI if I plan to give birth in UK. I understand that by birth my child if born in UK, will be British but will there be a complication in getting an OCI for the child if father is currently pakistani (although will be British in 3/4 years time).
    Please advise thoroughly as the time left is very short and I dont want to be split between kids, home and family. And who should I meet personally to seek advise in the UK.
    Appreciate your advise and help

    I don't think they will allow your child to have an OCI

      Give Birth in India

      Since you want to settle in India, the best alternative is to give birth in India and get Indian passport for the child.

        The child cannot get the Indian passport or Indian citizenship even if the mother gives birth to the child in India. India doesn't offer birth right citizenship like US. In order to be a citizen of India, here's what the law says:

        Any person born in India, on or after 26 January 1950 but prior to the commencement of the 1986 Act on 1 July 1987 is a citizen of India by birth. A person born in India on or after 1 July 1987 is a citizen of India if either parent was a citizen of India at the time of the birth. Those born in India on or after 3 December 2004 are considered citizens of India only if both of their parents are citizens of India or if one parent is a citizen of India and the other is not an illegal migrant at the time of their birth the citizen can be an Indian or a foreigner

          OCI Card

          As per OCI regulations, if either parent is eligible for an OCI card then the Minor will also be eligible. If you are eligible or hold an OCI card then your child will automatically be eligible.

          It is not an expert advise, for more details please contact the nearest Indian Mission.

            Hi Robust, did you applied for OCI card for your kid? Is it easy to get OCI card if either of the parents is of pakistani origin?

              As far as I know, any traces of Pakistani origin means no OCI.
