  • Minor British with Indian parents not elligible for OCI?

    Greetings,

I have applied for OCI for my minor son of 3 years. He is British citizen now. The Consulate in Glasgow sent his application back stating he is not elligible for OCI as both the parents are Indian citizens and refer to mha.nic.in and their website.

I have been to mha.nic.in and consulate's website so many times and the information in this case is very vague or not existing, at least to me. I see something in the elligibility stuff but doesnt look explicit to me.

Minor son's Indian passport was surrendered two months back and now he has got British passport.
Both of the parents (myself and mother) still have Indian passports and with PR stamps.

If that the case then either of us parents need to have British passport (in our case) then we can apply for ours and his OCI together?

Can anyone shed light on this please?

So this happens only in minor's cases? As if I were to go for OCI on my own then I am elligible being an adult! Certainly not helpful from MHA or whoever drafted the elligibility criteria for OCI.

    Many thanks.
    Siddharth.

    CGI Houston web site states

(Note: Minors (below 18 years) whose both parents are indian nationals are not eligible for registration as OCI. Atleast one parent of the minor should be a PIO having foreign citizenship to become eligible for the OCI scheme.)

The child may be eligible for PIO instead of OCI.
This is my opinion and not legal advice.
