PIO card not issued to minor, since parents VISA expired

  • PIO card not issued to minor, since parents VISA expired

    We applied for my son PIO card in New york.
    but they refused it, saying that parent do not hold approved VISA.

    My Work VISA ( L1B ) expired in May-2011
    and my son born on Jun-2011

    We have already filed for Extension of VISA, but the VISA is not yet approved.
    What if VISA get rejected ??

    So Option i have is to get tourist VISA for him and apply for PIO card from India.

    Is it possible , that a minor who is US citizen born to india parents can apply for PIO in india , while he is on tourist VISA ?

    You can apply again for his PIO once your visa status extension is approved.

    Alternatively, you can get tourist visa for him and once you go to India, you can apply for his PIO card from India.

      I have read on many sites ..that says below

      "Applications already in India on Long Term Visa (more than one year) shall make the application for issue of a PIO Card to the few offices in india"

      What does Long Term VISA means here ?

      I have applied for 5 Year multiple entry Toursit VISA. Can we call this VISA as "Long Term VISA" ? The max stay on tourist VISA is 6 month only ..

      Please advise me..

        When you go to India, are you planning to live there or visiting for a short term?

        If you are just visiting there, you can't apply for PIO there.

        You must be living there to apply.

          My VISA is still in pending status.. It is not yet approved or rejected...

          My wife and infants ( twins ) are going to india after two week...

          If my VISA does not approve , i will also go after some time and then will be in india permanently ... I think in that case I will nned to apply for PIO card from there...Can i do that while my infants are in tourist VISA ?

          If VISA approved then i will apply for PIO card here in USA..

            If you are going to India, your kids will need visa that allow them to stay in India for more than 6 months. And in that case, you can apply for their PIO there.

              Did you get the 5 year visa

              I was reading on this requirement just today as we will be in the same boat as you are in February. The 5 year visa they mention on the travisa site is an entry visa and not a tourist visa. Is that the one you applied for? Did you get it for the twins?

                        PIO not processed by BLS. Entry visa requirwements

                        BLS sent back my kids PIO application ( they did not consider I-94 as my valid USA status).
                        Now i am applying for India Entry Visa.
                        Will I-94 we accepted for Entry visa ? The BLS website does say that provide notasrized copy of I-94

                          I did the same thing, initially PIO rejected then applied for tourist visa and came to know with tourist visa we cant apply for PIO from india so had to go for Entry visa.
                          but Hi,for entry visa for my Kid, I had used USPS with return shipping with same USPS one day express which needs 20$ postage but once passport came back from consulate, BLS told me that there is no return envelop included so they used the postage I had included and I have to travel to SFO to collect the passport.
                          After that they dont ans to any calls so u will loose your return shipping money, so try using fedex with only label. One of my friend also had same case and lost the money.

                            I have similar situation where PIO application for my kid was returned due to visa expiry without considering I-94 date.
                            Did you apply Entry Visa based on I-94 date?
                            Did you notarize the I-94 copy?
                            Can we apply PIO from India after entering India with Entry Visa?

                            Please help..I have to send my kid to India asap.

                              pio card

                              just to help people who r in same situation...

                              I am f1 student and visa expired but valid I-20 until 06/2014 my wife was same F1 student... we submitted only I-20, PIO got approved.
