Indian visa for US born baby while parents L1 extension is denied

Hi,

We are on L1B visa and it is going to expire in may 2012. My Company is going to apply for L1A visa. The question is can we apply for the indian visa for our to be born child on the basis of L1 extension receipt while the extension is in progress? What are the options in case our visa extension gets denied and we have to leave the country, how can we get the visa for our newborn?

What I guess is, your case might be tied with some time sensitivity. It seems you don't have enough time such as 1-2 months between L1 expiration and baby born, why don't you apply for PIO card? I believe there is some faster services also available for all processes. Go through with all expedited processes. You can buy some additional time in case of L1 denied and for reconsideration of L1 petition.

Do you know if we can apply for PIO when extension is in process? Concerned about visa rejection and if i have to go back then then what visa we can apply for the baby.
