Me and my wife are both naturalized US citizens, I was born in India and held an Indian passport previously. My wife was born in Pakistan and as such, held a Pakistani passport which she gave up about 7 years back.
Per OCI requirements, only one parent has to be eligible for OCI for the minor child to be eligible. To my surprise, Travisa decided they were going to send my child's application back to me since he was in-eligible because of his mother previously holding Pakistani nationality.
Now I can understand if this was for PIO and mother currently was holding or ever held Pakistani nationality, however, for OCI there is no such requirement. I have refused to accept the documents for now and I am going to pursue this case as far as I can till I get the OCI for my son.
Has anyone ever been in the same boat? I read on a few forums that parents in my situation were able to get OCI for their kids. If there are any here, can you please share details, where did you apply for it etc.?
Per Travisa, Houston CGI has instructed them to return such OCI applications for minors. When I asked for where the rules were that stated this, they didn't have anything for me. They just said it's in their contract. Either Travisa doesn't want to deal with these kinds of applications because it may take longer than normal applications where both parents are former Indians which will be quicker to process or Houston CGI is using Travisa as a shield to refuse these applications unjustly. Please provide any feedback if possible.
5. Can Minor children apply for OCI?
Yes, if either of the parents is eligible for OCI.
