RENEW PASSPORT Using PREVIOUS EMPLOYERS I797 Approval Notice

Hi,
I switched jobs in April 2012 from employer A to employer B.
My Indian passport expired in May 2012.
My I797 approval notice with new employer(B) is still pending and not yet
received.

I have I797 approval notice with previous employer(A) valid till feb 2013.

Can I apply for passport renewal using previous employers (A) I 797 as valid
visa status?

Pending I-797 with new employer is the proof of your legal status. Show the receipt notice from that.
