Applying Indian Passport for US new born child

We are Indian citizens staying in US on L1 and are expecting a child soon. We are planning to get an Indian Passport for our kid in the US once born. Our question here is:
Neither of our passports have each others name listed as Spouse and our last names are different. We have valid INdian Marriage Certificate. Can we still apply and get Indian passport for your new born or there could be any problems ?
