  • Bringing back the child born in India for a US citizen monther and Indian father

    Hello All,
I am a U.S permanent resident with Indian Citizenship and my wife is a U.S citizen naturalized recently. She is planning to go to India for the delivery of our first child. We are trying to find out the procedure to bring the child back to US after the birth. Has anyone went through the same situation ? I could not find the correct answer anywhere on the internet regarding this.I read that if the citizen parent has lived physically in U.S for 5 years then we can get the CRBA to bring the child back to U.S , but in out situation it is only 4 years and hence i believe that is not possible. Is there any type of U.S VISA that we can apply after getting an India passport for the new born child.? Please share any information that you have regarding this..

    Thanks

Time in the US regardless of which visa she was on will be accepted, so get evidence for her time even before she became an LPR.

She came to United states in LPR status, putting it all together it is still only 4 years..

      Appreciate your response.
