  • File a Divorce suit in USA

'I and my husband are US citizens since 2004 and my kids are US citizens by birth. We are living in India since 2004. After separation in 2008, my husband moved to Guatemala in May 2009. Then he moved to Appleton, WI in 2013. I and my children have been living continuously in India. We have not been able to visit Wisconsin.
    My questions are:

    1. Will Appleton Family Court have Jurisdiction for my Divorce Suit?

    2. Will there any be legal implications of the fact that the minor children have not visited Wisconsin?

    Thanks.

Jurisdiction of the court is not an issue. But to get a divorce in any part of the U.S., you will have to satisfy the local residency requriements. Three months lcoal residency is about average. In Nevada, the residency period is 6 weeks.
