  • Is this EB2 or EB3?

    I currently have obtained my masters. However, when I started my job, I had not yet completed my masters and thus when I applied, I had to do so as EB3 (and wasn't picked in the lottery). Now that I have my masters, can I apply as EB2, or do I need to start a new job in order to be considered eligible for EB2 status?

    If the job that you are already working in doesnt require an EB2, then even if you are qualified for an EB-2 you would still be eligible to file only under EB-3. What you can try to do is shift your role/designation or take up an entirely new offer, which requires an EB-2 qualification and subsequently try to port your priority date. I believe you would have to file the PERM again.
