I am a physician in training of Indian nationality, currently on a H1B visa which expires at the beginning of June 2015. MY recapture time can extend my H1 to October 2015. So far I have not done anything to apply for a GC.
1. I have been offered a job as a physician/researcher in the place I trained. They conducted a recruitment process the way big universities conduct such recruitment (word of mouth information about job availability, no ads) and selected 2 others before offering me the remaining vacancy.
Can the labor certification process be done in time for the employer to sponsor my EB-2 GC?
2. I can try to apply for an EB1/EB2-National Interest Waiver (NIW) as a physician in an underserved area. Once again, what are the steps involved in this process and how long does it take?
3. My spouse is also on a H1. In case I don't have time to do any of the above can I transfer to a H4 on my wife's H1 and then continue this process?
