I was browsing the web for a while and cannot find the answer to this particular question. My husband and I are both biomedical scientists (Europe) and decided to apply for EB-2 NIW. My appointment with university ends sooner than my husband s (he is in the process of extending his J1, not subject to 212e, until October 2016), so we decided to go with him as a primary and have me switch to J2 and apply for EAD. We want to file I140 as soon as I enter US on J2.
Question: will filing I140 by him, affect my ability to get EAD as a J2. If we file both within a week, would my J2 EAD request get denied?
