    Hello,

    I self-petitioned I-140/I-485 and filed concurrently. I don't have the application receipt number yet and the USCIS says that it will come within 90 days. I am on academic H1 Visa. I need to know:
    1. If I move to a new employer (filing an H1 transfer), which I can technically do, how does that impact the petition processing.
    2. Do I have to wait until I get my EAD before I can move.

    Hi,

    You can technically take your H1 transfer. Your I-140 NIW/ I-485 is not employer specific. This should not be affected. However, you may have to face 2 potential issues:
    1. I believe you have to notify the USCIS of the change of your address. If you do it before your I-140 approval, you may get a RFE to explain that your change of location has not adversely impacted your work/field of work, which has been the basis of your I-140 NIW petition filing.
    2. If you move after approval of your I-140, the same question may appear at the time of approval of adjustment of status and you may have to appear for a personal interview for the approval.

    You may want to check with a good attorney as well.
