  • I-140 & I-485.. Please help

    My husband filed for green card under National Interest Waiver (EB2)
    category in July 2007 when it was current for India.

    He sent the forms I-140 & his I-485 together. I sent mine I-485
    (Spouse's under derivative status) later after couple of weeks.

    At first, both mine I-485 (under derivative status) & his I-485 was
    returned back at different time due to incorrect fee as was his. He sent
    his I-485 back with the correct fee & everything seems to have went
    fine. I sent back my I-485 (again under derivative status of my husband)
    with correct fee but it was returned back to us again with the
    explanation that I-140 (of husband) was not approved & processing was
    not current for India.

    Now, my husband sent the I-140 again in April 2009 in EB1-EA
    (extra-ordinary ability) category (while his I-485 was pending in
    NIW-EB2). The plan was once his EB1 I-140 gets approved, I'd send my
    I-485 (under derivative status) because EB-1 is current for Indians.

    Interestingly his EB1 I-140 got approved on May 26, 2009 & his I-485
    (which was filed with NIW EB2) was approved on June 05, 2009 i.e. he has
    got his GC it seems. We just found out about it y'day (June 06) through
    online status.

    I have not sent my I-485 (under derivative status) yet. Can I still
    connect my I-485 with my husband's now & how? What are the other
    options? Please help us.

    Both my husband & I has maintained our H1-B status & are still on H1-B
    individually.
