EB-2 NIW as self-petition still requires filling out sections J,K,L and M of ETA-9089 (or 750B). Two complications arise for the particular case of NIW in filling out ETA 9089:
1. In section J, there are questions that refer to section H. How should these be answered? For example: "J.20: Does the alien have the experience in an alternate occupation specified in question H.10? Yes/No/NA
2. In section M, the preparer has to sign under the statement: "I hereby certify that I have prepared this application at the direct request of the employer listed in Section C". Is this not automatically false in the case of NIW?
