I am a postdoctoral researcher at a national lab.
I am preparing to file for permanent residency for EB2-NIW category. One thing that came up recently was a possible job offer in a different country, which might be temporary (~ 6 months long).
I am wondering if someone would clarify this for me. Given the backlog in priority dates for India under EB2 category, I can only file for I-140 stage. My questions are as follows:
1. Once my petition is approved, can I leave the country?
2. If I come back to the US when my priority date is current(file for 485 state), do I need to have a job offer to obtain the green card at that point?
