H1 Max out - PERM pending - India travel - Please advice

Hi,

My PERM application was filed in EB2 cat with DOL on 6/30 got an audit on 8/31 and response was filed to audit on 9/27.
H1B max out is May 15th, 2013 currently I am in my last extension with petition approved till May 15th, 2013...

please respond to below questions..

1) What are the chances that I will get my PERM approved, I140 approved and H1 extension cleared after May 2013 ?
My lawyer informed me that they can file my I140 in premium process once Labour is approved.
2) I need to travel to India before Dec 2012 and I have to go for stamping for the same.
Will I face any issues/rejections since my PERM is still under review ?

I am with current employer since Feb 2011.
Please advice..
