Hi there, need an urgent advise on my situation. I am on my H1b extension 6th year (extention done here and do not have stamping done), H1 b status will max out on May 10 2013. PERM submitted end of Nov 2011 and waiting for approval. I need to travel to india for a couple of months and come back. My employer can do transfer to india office if required.
Can i go while my PERM is in process, and do I 140 and H1 extention while i am in India? and once H1 extention is done, i do the stamping and come back?
Since i do not have stamping done, by the time i come back i will have couple of months left on my current status and may have problems with stamping. What would you advise in this situation?
