Perm labor just filed and already in 6th year

Iam currently in my 6th year in US. My perm labor was filed in Dec 2012, almost after one month after my 6th year started. What are my options based on the labor application being audited or un audited, based on the fact that the filing was not done before the 6th year started.

I am in a similar boat and my application is under audit. I have been looking thru forums for the correct information and find contrary information on the web.

e.g. - The option 3 mentioned here is being stated not feasible by many law firms. Can someone here please confirm if the 365 day pending PERM eligibility for 1 year extension clause apply if the PERM was filed in the 6th year?
