This is my first post and i'd be really grateful for any help.
I have a job offer from a US company out of NYC. I am an English qualified lawyer (also admitted in NYC). I have a 4-year bachelor degree and a one year post-graduate "diploma" which is the professional qualification required in England in order to qualify as a lawyer.
I didn't get the H visa due to the lottery this year and my employer is not keen to do to PERM application as they aren't convinced that I would fall under EB2 categorisation seeing as my post-graduate study was technically a diploma not a masters.
Does anyone know of any USCIS decisions that deal with this? Any other way I can prove I would fall into EB2 category given I have study post baccalaureate level (and also 3+ years of work experience)?
