Need advise from you guys please.
US Entry date: 9/24/00
Visa expiration date: 3/12/06
My labor filing is in progress. i.e. advertisements etc is in progress. Company put ad in SWA 2 months back and also did ads in paper, website. Only step remaining is the ad with Private Empoyment Agency. I am told it has to be put for 30 days atleast (not sure if this is true). Based on this, I expect labor to be filed with labor dept by 1st Nov'05, no sooner.
Now, as such visa expires on 3/12/06 so I am already in 6th yr since visa issuance. But lawyers told that we can get credit for those 6 months as I entered US late. So considering my US entry date as starting point, I would enter 6th year on 9/24/05 and my labor will be filed with labor dept after that (1st Nov'05). I understand that labor has to be filed before 6th yr starts (i.e. prior to 9/24/05 in my case) in order to continue with 7th yr extentions till GC arrives as per the old labor system. I am not sure about new labor system rules.
So the question is: How can I stay in US after 13th Mar'06 ? Is there any way which can help me stay here ? Thanks a million for your response.
