LCA Question - current employer is acquired/merged with another company

Hi all,

If a person is working for company "A" and his Green Card is being processed through that company "A" and it is currently in Labor stage and on 7th year extension of H1 and it expires on June-2006, what will happen to that Labor if another company (Say Company "B") acquires/merges company "A".

1. Will the Labor be transferred from Company "A" to Company "B"? Is there a provision to transfer the Labor from one company to another incase of acquisition/merger.
2. Or do the Labor gets terminated?

What is the process.

Company B has to Report to the Labor Department about the merger. However, for a smooth process company B should continue to maintain the same Fed ID # of Company A.

I went through the situation you've described; my job duties did not change after the acquisition and therefore the LC processing continued without a problem. When the LC was approved, my lawyer filed an amended I-140 to continue the case.
