Applied PERM on 05Nov13 , H1 expires on Aug 14 , what are the options

    Hi ,
    My Employer applied PERM on 5th Nov 2013 Online with DOL. My H1 Expires on Aug 2014 (completing 6 year).

    I wanted to know ,
    1. how long it will take to get the PERM approved and what is the priority date for my case ?
    2. Can I apply for extension if I did not get approve by that time ?
    3. What are the option for me I 1 and 2 are not happening in time ?

    Appreciate your help !!!

    Hi Satyajeet,
    My employer applied for my perm and also applied for the H1B extension in a couple of weeks. Your employer should also do that I believe.

      How can someone apply for extension, when he is about to complete 6th year of H1B and the PERM is not approved. I don't get what you mean to say....

      My case is similar to Satyajeets. My PERM filed on Oct 31st 2013 and my 6th year H1B expires on Sept 2014.....

      Please share what can be done in this situation....

        Hi Thiru,
        I might be totally off so take my inputs with a big grain of salt but here is my situation.

        My H1B 6 years and I 797 expire in Feb 2015, but my H1B visa expires May 2014. Now when I last visited India in March 2013 I didnt show my latest I797 to the POE officer (what a stupid thing to do, but any way). So he stamped my I94 till May 2014(same as my H1B stamp). My Immigration department is telling me that the stamped I94 is considered as my max out date and not the I797 date. Not sure what is right.

        My employer also filed my PERM in Dec 2013 and they said that we can file for extension now for ~1.5 years till Jan 2016 and they did that in Feb 2014. I have the EAC #.
