  • Green Card Application / Labor Filed

    Hello All,

My current company filed labor application for my green card process last week in EB-3 Category ( May 15), Now - I am getting an employment offer from another company which will file Green Card after 6 months of my completion of services for that company. Salary hike is good - almost 15-20%.

Issue - If I will move to a different company, I think my GC process need to start from beginning because I don't have I-140 approved yet.

Question - Is there a way by which I can transfer existing labor filing and priority date to the new company green card process? If not, then would you recommend me to move to the new company because I believe after 6 or 8 months I will have approved I-140 and my wife can start working because of new EAD rule.

Advantage of moving to new company -
    1. More Salary
    2. EB-2 GC filing

Disadvantage of moving to new company
    1. Will lose the GC priority date
    2. Spouse will need another additional year to start work

Please advise. I am just curious to know if some one faced this situation and how they dealt with that. Appreciate your help in advance.
