    Hi,
    I am in 5th year of my H1 visa. 6th year for the H1 visa ends by December 2006. I applied LC traditionally on March 2005. I havent received the receipt number yet. I am thinking of applying LC thru PERM now. If my employer starts doing the paper work to apply LC thru PERM, it will take him atleast 2 months to complete it and apply. Considering my employer applies it by Feb 2006 and LC gets approved in 3 months, can my H1 be extended for 7th year based on the LC applied thru PERM?. Can 7th year extension of H1 be filed based on the LC approval?.
    I am asking this question because, it wont be one year since my LC has been applied thru PERM.
    Or is it possible to get 7th year extension using the LC applied traditionally though the receipt number is not received

    I also have same problem.
    I believe once you have Perm approved, you can stay as long as your GC is in process, but not sure.

    appreciate if someone could answer this question.

      1 yr before

      i was informed that u must have filed for ur labor atleast 1 yr in before ur h1 expires, then u can continue applying for extensions!!!
