  • US Green Card and Canadian PR in parallel?

    Hi All,

    I am working in the US on a H1B visa and my employer (very large American S/W Products company) will file my PERM in October this year. I also have completed all the pre-reqs for the Canadian PR (Educational evaluation, IELTS etc.) and have determined that I qualify for their express entry.

    Is it ok to have both these processes in parallel? Since, my PERM will get only filed in Oct, there is at least a year's wait time before I can get my I140. SO, my thinking was to also apply for the Canadian PERM in parallel and decide when I reach a certain stage in either of the processes as to which one to keep.

    Also, my company being a global American Product company, they have no problem in moving me to Canada if I ask them. I work FTE in a managerial role and not with a staffing company/body shop.

    The United States has no problems with aliens becoming permanent residents of multiple countries, as long as you adhere to the requirements of USLPR.

    I believe it is entirely possible to maintain the requirements of both USLPR and CLI, but you need to learn the rules and plan your commute accordingly. (US 6 month breaks, CA 730 days within 5 years)

    I also believe it is entirely possible to simultaneously maintain the physical presence requirements of both US and Canadian citizenship within their qualifying periods. (US 913 days in 5 years, CA 183 each days in 4 out of 6 years)

      Thanks. So per my understanding, applying for Canadian PR in parallel should not jeopardize my US Green Card processing right?
