Before I ask any question here is some background information:
My employer's headquarter was based out of Virginia. My employer filed for my PERM application in May 2014 for Virginia Location. This has already been audited in October 2014 and I am yet to hear response on that from USCIS.
In January 2015, my employer moved company headquarters to San Jose, California.
Note: My 6 year H1-B tenure is already over and my 1 year extension period will end in June 2016.
Question:
1. Now do I need to wait until I hear back any response from USCIS about Audit Review which I can expect to get somewhere around December 2015.
2. In worst scenario, if PERM is denied, what should I do? Do I need to re-appeal against that denial? So I can buy some time and apply for another 1 year extension for my H1-B. So I will get extension until June 2017 and if re-appeal also gets denied then my employer have enough time to start fresh PERM.
3. Do I need to ask my employer to start fresh PERM all-together right away?
