  • EB3 and PERM - NEED HELP!! ( a new question no body asked yet)

    Hi,
    GREAT forum.

I read the threads related to EB3 and PERM but didn’t find an answer to this question/situation.

I understand the PERM expedite the whole application process with the DOL, so instead of being approved after 2-4 years now it is possible to be approved in 60 days.

    My question:

If I apply to the Green Card by going with EB3, (and was approved by the DOL) how long do you think it takes me to get the green card???

Green Card/EB3- Is it still an endless process??

I was told by my lawyer that in 6-8 months I can have it---is it true??

I look forward to hearing your thoughts.

    Thank you.

Have the Green Card in 6 -8 months ... LOL!!!!

    Here is the procedure:
    1. Labor certificate
    2. File form I-140 (application for EB3) with the immigration.
    3. Hopefully approved in 6-8 months depending in which service center you file. Look here: https://egov.immigration.gov/cris/js...d=c-J-fMDp7K97 and see the processing times for your service center for form I-140 Skilled worker or professional.
    4. After your application is approved you file I-485 (application for adjustment of status). NOTE: YOU CAN ONLY FILE I-485 WITH YOUR DISTRICT OFFICE WHEN YOUR PRIORITE DATE BECOME CURRENT. Your priority date is the date you filed your labor certificate. Currently the immigration is processing application under EB3 with priority date before April 22, 2001 . You can find this info at http://travel.state.gov/visa/frvi/bu...etin_1770.html which is updated every month. So what does this mean? This means that you need to stay legally in the country for the next 4-5 years until you are able to file I-485 (application for adjustment of status). Thats right 4-5 years and if you are from India even longer.
    5. When your priority date become current you file I-485 with your district office to get your Green Card. Once you file this application you do not need any other visa to stay on because I-485 allows you to stay legally here. You can work and travel but have to work for the initial employer for at least 180 days after I-485 was filed. After that you may change employers as long as you stay in the same occupation.
    6. You will be called for a interview at your District Office when your I-485 gets processed. You can find when this happens again here: https://egov.immigration.gov/cris/js...d=c-J-fMDp7K97 and check for your city at District Offices Processing Times. After you pass your interview you have your Green Card.

    6-8 months .... LOL!!!
