So background of the story is I have an approved I-140 with priority date of 28th June 2010, in EB3 category from my previous employer, I was eligible to apply for EB2, but because my previous employer was conservative he felt EB3 would be a smooth process.
Anyhow in 2011 I joined another employer and restarted my Green card process, my labor was approved, and the plan was to port EB3 to EB2 in the I-140 stage, however because of mismanagement from my current company and the law office they didn’t file my I-140 in time and my perm labor expired.
Now in 2015 May they have restarted my perm labor process and my question is can it be expedited in anyway base on my 2nd approved labor which expired, and what are the other steps I can take to get my EAD, as the priority date for EB2 India is now Jul 2011 and if I’m able to successfully port my date EB3 – EB2 and use my priority date of 28th June 2010, I will be well on my way to the EAD life.
