I hope to find the answer here on my PERM Appeal Withdrawal. Story is the following:
My PERM Application was denied after Audit and my employer filed an Appeal.
A bit later, in December 2015, we decided to withdraw the appeal.
After online withdrawal was requested, we received the following status from DOL:
Dear Sir/Madam:
Thank you for your inquiry to the Atlanta National Processing Center (ANPC) concerning your case filed under the Permanent Labor Certification Program.
Please be advised, the employer's request to withdraw case # has been received and is currently under review. Official correspondence will be forthcoming.
Requests for withdrawal are processed in the order of their Center receipt date, as expeditiously as possible. The Department of Labor has a long-standing policy of not expediting any applications and application withdrawals, including requests for the Permanent Labor Certification Program. Please be assured we endeavor to afford every request both careful attention and timely processing.
Once the online status of the initial application is changed to <SELECT: Withdrawn / Denied>, the employer may submit a new application with the corrected information.
Its been a month since withdrawal was requested and we still have no written confirmation of Appeal withdrawal.
Online status of my application shows: "Denied" and we are not sure if we can proceed with filing a new PERM application or not.
The answer from DOL I posted above, contains confusing information, saying that my employer can file new PERM once status is changed to <SELECT: Withdrawn / Denied>.
Does it mean exact status "Withdrawn / Denied" or one of the statuses ("Withdrawn" OR "Denied")?
Should DOL send us Appeal withdrawal confirmation at all?
